A question was raised before the High Court of Delhi which asked is the Council for the Indian School Certificate Examinations (CISCE), which like CBSE conducts the class 10 and 12 exams falls under the transparency law RTI?
The question is of significance as the exams which are conducted by the CISCE too are the basis for getting admissions in the educational institutions here and abroad.
The issue was listed for consideration on November 17 by Justice Vibhu Bakhru who said that this is an anomalous situation. He said that CBSE is a public authority which falls under the purview of Right to Information (RTI) Act while CISCE, which perform the same functions and does not fall under RTI.
Jasmeet Singh, Central government standing counsel, said that CISE is only a society and not a public authority and therefore, it would not come under the ambit of RTI. Jasmeet Singh was appearing for the Human Resource Development Ministry and the Prime Minister's Office.
He said "CISCE was not controlled by the Centre as in the case of CBSE and added that the Central Information Commission (CIC) has rightly held that the Council did not come under the ambit of RTI".
